Re: Property Development Along the West Coast

During the entire Hondeklip Bay development dispute, the major obstacle and frustration we had to overcome was to provoke action and response from the various departments and organizations concerned. Although we located, consulted and then quoted the relevant acts, laws and bylaws to DEAT Springbok and DEAT Northern Cape, DEAT National as well as the Kamiesberg Municipality, SPP, NC Premiers Office and numerous other vaguely relevant organisations, nothing was done to stop the unlawful action while it was in progress. At the time of the MEC’s (DEAT - NC) visit to Hondeklip Bay, the contractor was on site, carelessly destroying virgin coastal vegetation!
Included in the MEC’s entourage was all and sundry directly or remotely associated with DEAT Northern Cape. Nonetheless, NO action, immediate or subsequently, was taken. In fact, the developer’s actions was approved and made out to be constructive to the community’s welfare and future by the MEC. It was only after we initiated a major campaign (see below), that some action was taken. To date, no official - as in writing, proof has been conveyed to let us know that the development has been terminated. The only real evidence that we have about the matter being under investigation is a letter from DEAT National and the Premier of the Northern Cape’s office, referring the matter, ironically, to MEC Saaiman! The developer has also left the scene of the crime and will, with any luck, be held responsible for his actions sometime in the future. The Kamiesberg Municipality still denies any involvement in the matter and blames the developer for not “observing” the law. I shall rest my case.

Onwettige onderverdeling en ontwikkeling te Hondeklipbaai

Hiermee wens ek u dringende aandag te vestig op die onwettige onderverdeling van erwe 13 en 14 en gepaardgaande dorpsontwikkeling te Hondeklipbaai, Namakwaland.

Volgens die ontwikkelaar, ene mnr. Dirk James handeldrywend as D J LIB ONDERNEMINGS C C, se regsverteenwoordiger, het hy alle wetlike vereisdes nagekom wat betref die onderverdeling en ontwikkeling van bogenoemde erwe.
Sy skriftelike reaksie op my versoek na die gepaardgaande dokumentasie is aangeheg (sien aanhegsel 1 en 2 ). Op 18 Oktober 2005 is daar op genoemde persele deur ‘n kontrakteur, mnr. Frans van den Heever, met die skraap en bou van die strate begin. Nieteenstaande die gemeenskap se sterk beswaar en aanmelding van die situasie by die volgende instansies en persone -
· DEAT: Mnr. Anton Meyer, Mnr. Cupido, Me.Wilna Oppel en Mnr. P.W. Saaiman
(LUR).
· Kamiesberg Munisipaliteit: Mnr. Piet Sochop (Raadslid), Mnr. Gert Maerman

- word daar steeds niks aan die saak gedoen nie en is die kontrakteur steeds besig om voort te gaan met konstruksie.

Indien hierdie toestemming wel kragtens die “Northern Cape Planning and Development Act No 7, 1998 Art 49” toegestaan is, bevraagteken ek die nakoming en uitvoering van die vereistes in onderstaande artikels van die bogenoemde Wet:

· Art 48. (2)
· Art 49. (3)
· Art 64. (1) (a), (b) en (c) en (2)
· Art 65. (4) (a) indien van toepassing.

· Aanhangsel “A” en gepaardgaande dokumentasie met spesifieke verwysing na

Daarbenewens is ek ook van mening dat die voorwaardes in die “Environment Conservation Act. 1989 met spesifieke verwysing na “Amendment no. R.670”
artikels 1 en 10 beslis nie na my wete nagekom is nie.

Ek en my gemeenskap beroep ons dus nou uiters dringend op u spoedige reaksie en ondersoek van hierdie saak sodat bogenoemde ontwikkelaar gedwing sal word om onmiddelik sy bedrywighede te staak. Volgens die definisies soos uiteengesit in die Wetsontwerp op Nasionale Omgewingsbestuur, is hierdie situasie beslis nie wetlik of sosiaal aanvaarbaar nie.
